These Terms & Conditions (“Terms”) govern your access to and use of BenchCode and related websites or materials offered by or on behalf of Advantage AI Engineering Private Limited (“Company”, “we”). Coding at your bench — a local-first feel: many deployments run entirely on your infrastructure; your obligations may include securing that environment and complying with licenses for models and third-party services you enable.

1. Acceptance

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

BenchCode provides tools for AI-assisted software development, including chat, code generation, optional GitHub integration, and configurable model backends. Features may change over time. We do not guarantee uninterrupted or error-free operation.

3. Accounts

You are responsible for safeguarding credentials and for activity under your account. Where approval workflows exist (e.g. admin activation), access may be limited until approved.

4. Acceptable use

You will not misuse the Service: no unlawful activity, no infringement of others’ rights, no attempt to bypass security, and no overload or abuse of shared infrastructure. You comply with applicable laws and with third-party terms (GitHub, cloud APIs, open-source licenses).

5. Your content

You retain rights to your prompts and outputs subject to your agreements and law. You grant us only the rights needed to operate the Service you use (for example hosting, processing requests, and support). You represent you have the rights to submit any code or documents you upload.

6. Third-party services

The Service may integrate with third-party APIs or repositories. Those services are governed by their own terms; we are not responsible for their availability or behavior.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-generated code may be incorrect or insecure; you must review, test, and validate before use in production.

8. Limitation of liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability shall not exceed the greater of amounts you paid us for the Service in the twelve months preceding the claim or one hundred dollars (USD), except where prohibited by law.

9. Indemnity

You will defend and indemnify the Company against claims arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

We may suspend or terminate access for violations of these Terms or for operational reasons. You may stop using the Service at any time.

11. Changes

We may update these Terms by posting a revised version and updating the “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
